Terms of Service

Welcome to KloudSec. By accessing or using our cloud security platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you (either an individual or the organization you represent) and TOC Consulting ("KloudSec", "we", "us", or "our"), the company operating the KloudSec platform, based in Paris, France.

KloudSec is a Cloud Security Platform that scans your cloud infrastructure for security vulnerabilities, compliance issues, and misconfigurations.

The Service includes:

• Automated security scanning of AWS accounts (with GCP projects and Azure subscriptions on our roadmap)
• Vulnerability detection and compliance monitoring
• Security findings dashboard and reporting
• Remediation guidance and recommendations
• API access (on applicable plans)

Service Changes: Features may change, be added, or removed as the Service evolves. We'll make commercially reasonable efforts to notify you of significant changes.

To use the Service, you must:

• Be at least 18 years old or the age of majority in your jurisdiction
• Provide accurate and complete registration information
• Have the authority to bind the organization you represent (if applicable)
• Maintain the security and confidentiality of your account credentials

You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach.

To provide the Service, you grant KloudSec read-only access to your cloud infrastructure (for example, via an IAM role for AWS):

• Read-Only Access: KloudSec only requires and will only use read-only permissions to scan your cloud resources
• No Write Permissions: We never request or require permissions to modify, delete, or create resources in your cloud account
• Revocable: You may revoke KloudSec's access at any time (for example, by deleting the IAM role or CloudFormation stack for AWS)
• Your Responsibility: You are responsible for ensuring the access role permissions are correctly configured

14-Day Free Trial: New customers receive a 14-day free trial with full access to features. No credit card is required for the trial. At the end of the trial period, your access will be limited unless you subscribe to a paid plan.

Paid Subscriptions: Paid plans are billed monthly or annually in advance. By subscribing, you authorize us to charge your payment method for the subscription fees.

Cancellation: You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial months or unused time, except as required by applicable law (see Section 6 for French consumer withdrawal rights).

Price Changes: We may modify subscription pricing with at least 30 days' notice. Price changes will not affect your current billing period.

In accordance with French consumer law (Code de la consommation, Articles L221-18 and following), if you are a consumer based in France or the European Union:

Note: This withdrawal right does not apply to business customers purchasing services for professional use. Business subscriptions follow the cancellation terms in Section 5.

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove, obscure, or alter any proprietary notices on the Service
• Use the Service to scan cloud accounts you don't own or don't have authorization to scan
• Interfere with or disrupt the Service or our servers/networks
• Use automated systems to access the Service in a manner that sends more requests than humanly possible
• Share your account credentials with unauthorized third parties

Enforcement: We reserve the right to suspend or terminate your account if you violate this Acceptable Use Policy.

Our Rights: KloudSec and all related trademarks, logos, and service marks are owned by TOC Consulting. The Service, including its software, design, and content, is protected by copyright, trademark, and other intellectual property laws.

Your Rights: You retain all rights to your cloud infrastructure data and configurations. By using the Service, you grant us a limited license to access, process, and analyze your data solely to provide the Service.

Limited License: We grant you a non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes, subject to these Terms.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not fully apply to you. You may have additional rights under applicable consumer protection laws.

You agree to indemnify, defend, and hold harmless TOC Consulting, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including your cloud provider's terms of service
• Unauthorized access to your account due to your failure to safeguard credentials

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

GDPR Compliance: For users in the European Union, we comply with the General Data Protection Regulation (GDPR). You have rights regarding your personal data, including access, correction, deletion, and portability. See our Privacy Policy for details.

Data Deletion: Upon account deletion, we will delete your data in accordance with our Privacy Policy. You may request data deletion by emailing hello@kloudsec.io.

Your Right to Terminate: You may terminate your account at any time by emailing us or using the account deletion feature in your dashboard.

Our Right to Terminate: We reserve the right to suspend or terminate your access to the Service at any time for:

• Violation of these Terms or our Acceptable Use Policy
• Non-payment of subscription fees
• Fraudulent or illegal activity
• Discontinuation of the Service (with reasonable notice)

Effect of Termination: Upon termination, your right to access the Service immediately ceases. We will delete your data in accordance with our Privacy Policy. Sections that by their nature should survive (including Intellectual Property, Disclaimers, Limitations of Liability, Governing Law) remain in effect.

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms on this page with a new "Last Updated" date
• Sending an email notification to your registered email address
• Displaying a notice in your account dashboard

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and may terminate your account.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and KloudSec regarding the Service.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

No Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

Force Majeure: We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.
